Terms of Service

Welcome to SolGuide. By downloading, accessing, or using our mobile application and website (the "Service"), you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account or using SolGuide, you confirm that:

• You are at least 13 years old (16 if in the European Economic Area)
• You have the legal capacity to enter into a binding agreement
• You agree to comply with these Terms and our Privacy Policy

2. Service Description

SolGuide is a Costa del Sol travel guide application that uses artificial intelligence to generate personalized travel itineraries based on your preferences. The Service includes:

• AI-generated travel routes and recommendations
• GPS-based audio guides
• Curated points of interest (restaurants, beaches, attractions)
• Transport tips, parking information, and seasonal advice

3. Subscription Plans

SolGuide offers multiple subscription plans:

• Free: Limited to 1 route per month, 1-day maximum, 3 unlocked stops
• Explorer: €4.99/month or €3.49/month annual — unlimited routes up to 7 days, all stops unlocked
• Premium: €9.99/month or €6.99/month annual — everything in Explorer + routes up to 14 days, premium tips, GPS audio guide, offline mode, 4 languages
• One-trip: €14.99 one-time — all Premium features valid for 30 days from purchase

3.1 Billing

• Subscriptions auto-renew unless canceled at least 24 hours before the renewal date
• Payment is charged through your Apple App Store or Google Play account
• Prices include VAT where applicable
• Annual subscriptions offer a 30% discount over monthly billing
• We reserve the right to change subscription prices with 30 days' notice

3.2 Cancellation

• Cancel anytime through your Apple App Store or Google Play subscription settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial periods (per platform policy)

3.3 Refunds

Refund requests are handled directly by Apple App Store or Google Play, per their respective policies. SolGuide does not process refunds directly.

4. User Responsibilities

You agree to:

• Provide accurate registration information
• Keep your account credentials secure
• Use the app for lawful, personal travel planning purposes only
• Verify safety, accessibility, and operational details before traveling
• Respect local laws, customs, and property at recommended locations
• Not reverse-engineer, decompile, or extract source code from the app
• Not use the app to scrape, copy, or redistribute SolGuide content

5. Intellectual Property

All content in SolGuide — including text, graphics, logos, icons, AI-generated routes, audio guides, and curated recommendations — is the property of SolGuide or its content suppliers and is protected by international copyright laws.

You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes only.

6. AI-Generated Content Disclaimer

SolGuide uses third-party AI (including OpenAI's GPT models) to generate routes and recommendations. You understand and accept that:

• AI-generated content may contain inaccuracies, hallucinations, or outdated information
• Recommendations are suggestions, not guarantees
• SolGuide is not liable for decisions made based on AI-generated content
• You should always verify critical details (prices, hours, safety, accessibility) before traveling
• Audio guides generated by ElevenLabs are for entertainment and informational purposes only

7. Third-Party Bookings & Affiliate Links

SolGuide may include affiliate links to third-party booking platforms (Booking.com, Viator, GetYourGuide, and others). When you book through these links:

• You enter into a separate agreement with the third-party provider
• SolGuide may receive a commission from the booking platform
• SolGuide is not responsible for the quality, safety, or fulfillment of third-party services
• All disputes related to bookings must be resolved with the booking platform directly

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOLGUIDE AND ITS OWNERS, EMPLOYEES AND LICENSORS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Damages arising from your use of or inability to use the Service
• Damages arising from third-party services or content (restaurants, hotels, transport providers)
• Personal injury, property damage, or other harm related to travel activities suggested by the app

You travel and engage in activities at your own risk. SolGuide is a planning tool, not a tour operator.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SOLGUIDE DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

10. Service Availability

We strive to keep SolGuide available 24/7, but cannot guarantee uninterrupted service. The Service may be unavailable due to:

• Scheduled maintenance
• Third-party service outages (Supabase, OpenAI, Google Maps, ElevenLabs)
• Force majeure events

We may modify, suspend, or discontinue any feature at any time without prior notice.

11. Safety & Travel Advice Disclaimer

SolGuide provides travel recommendations and routes for informational purposes only. We do not guarantee the safety, accuracy, or suitability of any route or attraction. Users travel at their own risk and should:

• Check current travel advisories and local conditions
• Follow all local laws and customs
• Use common sense and stay aware of surroundings
• Consult official tourism boards for current information

12. Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent, abusive, or illegal behavior
• Attempt to harm the Service or other users

You may terminate your account at any time via Profile → Settings → Delete Account, or by emailing hello@solguide.app.

13. Indemnification

You agree to indemnify and hold harmless SolGuide from any claims, damages, losses or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Málaga, Spain, except where mandatory consumer protection laws of your country of residence apply.

15. EU Consumer Rights

If you are a consumer in the European Union, you have a 14-day right of withdrawal from digital purchases. By starting to use the app immediately after subscription, you expressly waive this right, as the service begins immediately.

16. Changes to Terms

We may modify these Terms at any time. Changes become effective when posted on this page. Continued use of the Service constitutes acceptance of the updated Terms.
